What is our Trademark Attorney Fee Guarantee?
For clients who choose our Trademark Registration Service above, trademarks that pass our knockout search will be greenlighted for our Trademark Attorney Fee Guarantee.
Our Trademark Attorney Fee Guarantee includes:
A) a full refund of attorney’s fees if the USPTO issues a likelihood of confusion refusal and the client chooses not to respond to the Office Action; or
B) a 50% refund of attorney’s fees if the client chooses to respond to a likelihood of confusion refusal and our response does not lead to a withdrawal of the refusal.
USPTO fees are non-refundable.
How does our Trademark Attorney Fee Guarantee work?
Our Trademark Attorney Fee Guarantee is a money-back guarantee of attorney’s fees on your trademark application if it ever receives a likelihood of confusion refusal and you do not wish to argue against the refusal. Think of it as insurance against a rejection that your applied-for trademark is too similar to another registered trademark.
When you choose our Trademark Registration Service above, our Trademark Attorney Fee Guarantee will apply to each greenlighted trademark that passes our knockout search.
For a trademark to be greenlighted for our guarantee, our firm will send written confirmation that your mark passed our knockout search.
If your application receives a likelihood of confusion rejection, each greenlighted trademark will get the following benefits :
- 100% refund of all attorney’s fees in your trademark application if you choose not to argue against the likelihood of confusion refusal;
- 50% refund of all attorney’s fees in your trademark application if you choose to respond and our response does not overcome the likelihood of confusion refusal; or
- a successful withdrawal of the likelihood of confusion refusal, in which case we keep our attorney’s fees.
